“One Tasty $10,000 Summer Vacation” Sweepstakes
Official Rules

  1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. Sweepstakes is open only to legal residents of the 50 United States and the District of Columbia and active duty military personnel regardless where stationed who are 18 years of age or older and have a valid drivers license as of March 1, 2007. Each Winner and his/her travel companion(s) may be required to have valid passports or other required travel documents at the time of travel. Employees of Otis Spunkmeyer (the “Sponsor”), Fulfillment Systems Inc. (the “Judges”), or any of their affiliate companies, agencies, promotion suppliers, printers and their immediate families are not eligible to enter or win. Void in Puerto Rico and where prohibited by law. By entering you agree to these Official rules and the decisions of The Sponsor and the Judges, which shall be final and binding in all matters relating to this Sweepstakes. Sweepstakes begins at 12:00 a.m. ET on March 1, 2007 and ends at 11:59 p.m. ET on July 31, 2007 “Sweepstakes Period”.
  2. How to Enter:
    1. Website Entry: Enter by visiting www.tastysummer.com during the “Sweepstakes Period” and follow the directions to complete and submit an official entry for this Sweepstakes.
    2. Mail-in Entry: You may also enter by hand printing on a 3” X 5” card, your first and last name, address, age, daytime phone number, email (if applicable) and the UPC code of your purchased Otis Spunkmeyer product (optional) and mail in an envelope to: Tasty Summer Vacation Sweepstakes, P.O. Box 3825, Department E, St. Cloud, MN 56397-3825. Mail in entries must be postmarked by August 1, 2007 and received by August 8, 2007 to be eligible. Entries must be mailed in separate envelopes.
  3. Limits: Limit of four entries per household/address regardless of method of entry. All entries become the exclusive property of Otis Spunkmeyer and none will be returned. If subsequent attempts to enter are received, all entries will be disqualified. The submission of an entry is solely the responsibility of the entrant. Entries may only be made according to the methods described above. Proof of sending (such as an automated computer receipt confirming delivery of email, "thanks for entering" message or post office receipt) does not constitute proof of actual receipt by Otis Spunkmeyer of an entry for purposes of these Official Rules. Automated entries (including but not limited to entries submitted using any bot, script, macro, or sweepstakes service), copies, third party entries, facsimiles and/or mechanical reproductions are not permitted and will be disqualified. Only eligible entries actually received by Promotion Entities before the end of the specified entry period will be included in the prize drawing. Illegible, unintelligible, incomplete, garbled, or mutilated entries will be disqualified. All entries become the property of Otis Spunkmeyer and none will be acknowledged or returned.
  4. Laws and Regulations: Any Sweepstakes entries not complying with any applicable federal, state and municipal laws or regulations will be considered null and void. By entering the Sweepstakes, entrants agree to comply with and be bound by these Official Rules. The Official Rules will be posted at the Sweepstakes website throughout the Sweepstakes. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Entrants further agree to comply with and be bound by the decisions of the judges, which will be final and binding in all respects. Otis Spunkmeyer reserves the right at its sole discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or any Otis Spunkmeyer website; (b) violating the Official Rules; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Otis Spunkmeyer property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, OTIS SPUNKMEYER RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
  5. Prizes:
    1. Three (3) Grand Prizes: Each Grand Prize winner will choose (1) One of the following (3) Three “Tasty Summer Vacation” options: Trip is for (1) winner and (3) companions to Option # 1) Bar Harbor, Maine, Option # 2) Costa Rica or Option # 3) Belgium. Trip includes approximately 6 day/7 night accommodations at a hotel of Sponsor’s sole choosing. Grand Prize trip to consist of round trip coach air transportation for winner and companions from the major commercial airport nearest winner’s residence to nearest major commercial airport of destination, two (2) standard, double occupancy hotel room accommodations, and mid-size car rental during stay. To accept rental car component of prize, winner must have a valid driver’s license currently in force, be at least 25 years old and have at least one major credit card in good standing, as well as complying with all other terms of standard rental car agreement. If winner does not qualify for rental car, he/she will receive ground transportation between destination airport and hotel. The Grand Prize winner and all travel companions must travel on the same itinerary including the same departure date, destination and return date. Exceptions for travel accommodations may be considered for any active military personnel at the Sponsor’s sole discretion. No stopovers are permitted on tickets issued as a prize; if a stopover occurs, the prize will terminate at the stopover point and full fare will be charged for the remaining segments, including the return of the trip. Neither Sponsor nor sponsor affiliates will be liable for any expenses incurred as a consequence of a flight cancellation or flight delay. Schedules subject to change without notice. Meals, gratuities and all other unspecified incidental expenses for this prize are the sole responsibility of winner. Approximate retail value (ARV) of each trip: $10,000. Total Approximate Retail value of all prizes is: $30,000. (Grand Prize value may vary depending upon the actual cost of air transportation from point of departure and accommodations at time of reservation but cannot exceed $10,000.)
    2. Winners will be given the option of receiving $10,000 cash, subject to sponsor’s approval, which will be awarded in the form of a check. Without limiting the foregoing, Grand Prize is subject to availability/blackout dates andsome additional restrictions may apply to award of Grand Prize as set by Sponsor in its sole discretion. Grand Prize trip must be completed within one year from the date of prize acceptance; and, winner must give at least 60 days advance notice prior to intended date of departure. Sponsor will not provide compensation or alternate travel destination in the event that the winner and/or their guests cannot travel on dates reserved and, once reserved, travel dates cannot be changed. For travel to Costa Rica or Belgium, prize winners and their respective travel companions must provide copies of valid passports and any other travel documents that may be required to comply with foreign government regulations. All tickets issued in conjunction with the Prizes are not eligible for frequent flyer miles, and no code-share flights may be used The Sponsor further disclaims any and all representations and warranties, expressed or implied, in fact or in law, in connection with all prizes; the only representations and warranties are those provided by the party rendering the service or manufacturing the goods in question (as appropriate). By claiming a prize, winner agrees to assume all risks and agrees that the prize is awarded upon the condition that The Sponsor, Fulfillment Systems Inc., and their respective agencies, parent companies, subsidiaries and affiliates, as well as the officers, directors, employees, shareholders and representatives of any of the foregoing entities will have NO liability whatsoever for any injuries, losses, death or other damages of any kind caused by the prize or resulting from acceptance, possession, or use/misuse of the prize or from winner’s participation in the Sweepstakes. Promotion Entities will not replace any lost or stolen prize items
  6. Drawing and Notification Details: Winners will be selected in a random drawing on or about August 15, 2007 from all eligible entries received from all methods of entry. The drawing will be conducted by Fulfillment Systems Inc., the Official Judging Agency, at its offices in Monticello, Minnesota. The odds of winning will be determined by the total number of eligible entries received. Winners will be notified by mail or phone. Grand Prize winners will be required to sign and return (as applicable) an affidavit of eligibility, publicity/liability release and travel companion documents within 14 days following the date of notification of Grand Prize winners. Guests of Grand Prize winner (if guest is a minor, his/her parent or legal guardian) will also be required to execute and return a liability/publicity release, prior to issuance of travel documents. Grand Prize winner and his/her guests understand and agree that the prize features an inherent risk of injury (or even death) and each expressly assumes all risks related thereto and further understands and agrees to sign and return upon request all additional documentation furnished by the Sponsor and/or a prize supplier, for any component of the prize that may be required in conjunction with acceptance therewith. If guest(s) of winner are minor(s), a parent/legal guardian, who will count toward the total of four (4) travelers, must accompany them on trip. If the winner cannot find three (3) guests to join him/her on the trip, winner will not receive any refund for unused portion of the prize; and prize components (e.g., hotel accommodations, air travel) will only be awarded in amounts appropriate to the number of travelers actually taking trip. In the event of non-compliance with the above-indicated requirements, the selected entrant will forfeit the prize and an alternate Grand Prize winner will be selected from among all remaining non-winning eligible entries received for the drawing. Winners will be disqualified and prize will be awarded to an alternate winner (selected from all remaining eligible entries) if all affidavits/releases are not signed and returned as required, or if prize notification or prize is returned as undeliverable. By accepting prize, winners agree to the use of their name and/or likeness in any promotion/advertising/trade activities, and any and all rights to said use, without further compensation or notification, except where prohibited by law. Winners will be issued an IRS Form 1099, which documents the value of the prize for tax purposes. Any difference between actual value of a prize and the approximated value of a prize as stated in these Official Rules will not be awarded.
  7. General:

    1. The Sponsor and its agencies are not responsible for lost, late, damaged, postage due or misdirected mail/entries. In addition, Sponsor and its agencies are not responsible for any incorrect or inaccurate information, whether caused by Web site users, by any of the equipment or programming associated with or used in the Sweepstakes, or by any technical or human error that may occur in the processing of entries in the Sweepstakes.
    2. Sponsor and its agencies are not responsible for any problems or technical malfunction of; computer online systems, servers, or providers; computer equipment; computer software; or failure of e-mail or entry on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to participant’s or to any person's computer related to or resulting from participating or downloading materials from the Web Site or Sweepstakes. If, for any reason, the sweepstakes is not capable of running as planned, due to without limitation, infection by computer virus, worm or bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor, that in the sole opinion of Sponsor, could corrupt or affect the administration, security, fairness, integrity, or proper conduct of this sweepstakes, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes. In such event, winners will be selected from among all eligible mail in entries and all eligible online entries received prior to and/or after (as appropriate) the action taken by Sponsor or by some other method determined by Sponsor in its sole discretion as fair, consistent, and in accordance with the spirit of these Official Rules. And, notice of such action by Sponsor will be posted on the website. E-mail entry will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entries may not be reproduced in any manner and entries, which are lost, misdirected, delayed, incomplete, illegible, defaced, mutilated, forged or in any manner altered will be disqualified.
  8. Information Collection Practices. Personal information collected in conjunction with this Sweepstakes will be used by Otis Spunkmeyer to administer the Sweepstakes, including notification of winners and inclusion of winners’ names on a publicly available winners list. Personal information may also be used by Otis Spunkmeyer for future marketing/marketing research efforts, unless entrant has opted out. Sponsor will share personal information with a third party (Fulfillment Systems Inc.) so that it may perform its judging function in the Sweepstakes. This Sweepstakes is subject to the privacy policy, available at www.tastysummer.com/privacy policy.
